1. Definitions
- "Service" — the Privedge AI inference proxy, SDK, and related infrastructure.
- "Customer" — the individual or organization accessing the Service.
- "End User Data" — data belonging to the Customer's users that passes through the Service.
- "Self-host" — deploying the MIT-licensed Privedge Worker code in the Customer's own Cloudflare account.
2. Acceptable use
You may use the Service to proxy AI inference requests and protect end user privacy. You may not:
- Use the Service to violate any applicable law or regulation
- Attempt to circumvent the anonymization pipeline to leak PII to AI providers
- Resell access to the Service without a written reseller agreement
- Use the Service to process data beyond your authorized tier's request limits
3. Self-host (MIT license)
The Privedge Worker code is MIT licensed and freely available at github.com/privedge/privedge. You may deploy it in your own infrastructure at no cost, without limitation. In self-host mode, Privedge holds no data and these terms apply only to your use of any managed cloud features you optionally enable.
4. Cloud service — subscription and billing
Cloud mode is a monthly subscription billed via Stripe. Spend limits are enabled by default — you will not be charged for overages without explicit consent. Unused requests do not roll over. You may cancel at any time; access continues until the end of the billing period.
5. Privedge as a mitigation tool — limitation of liability
Privedge is a technical mitigation layer that reduces the exposure of PII to AI providers. It is not a guarantee of absolute privacy or full regulatory compliance in all jurisdictions and contexts. Specifically:
- Detection is based on regex patterns (v1) and NER models (v2). Novel or obfuscated PII formats may not be detected.
- Customers remain responsible for configuring the Service appropriately for their use case, jurisdiction, and data classification requirements.
- Customers are responsible for ensuring their end users do not deliberately circumvent anonymization (e.g., encoding PII to evade detection).
- Privedge does not provide legal advice. Use of the Service does not constitute compliance with GDPR, HIPAA, or any other regulation — that determination must be made by the Customer and their legal counsel.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PRIVEDGE'S LIABILITY FOR ANY CLAIM ARISING FROM USE OF THE SERVICE IS LIMITED TO THE AMOUNT PAID BY THE CUSTOMER IN THE THREE MONTHS PRECEDING THE CLAIM.
6. Data processing
Privedge processes Customer data as a Processor under GDPR. The terms of our Data Processing Addendum (DPA) govern this processing and are incorporated by reference into these Terms. The DPA is available at /docs/dpa. Enterprise customers may request a customized signed DPA.
7. Uptime and SLA
- Free/Pro: Best effort. No SLA.
- Enterprise: 99.9% monthly uptime SLA with service credits per contract.
Planned maintenance is excluded from SLA calculations and will be communicated in advance.
8. Intellectual property
The Privedge Worker code is MIT licensed. The Privedge brand, website, and documentation are © 2026 Privedge. You may not use Privedge trademarks without written permission.
Customer retains all ownership of their data and prompts. Privedge does not claim any rights to Customer data processed through the Service.
9. Termination
Either party may terminate cloud access at any time. Privedge may suspend access for material breach of these terms, including non-payment or violation of acceptable use. Upon termination, Customer data is deleted within 30 days.
10. Changes to these terms
We may update these terms. Material changes will be communicated with 30 days' notice via email. Continued use after the effective date constitutes acceptance.
11. Governing law
These terms are governed by the laws of Spain (EU). Any disputes shall be resolved in the competent courts of Spain, without prejudice to mandatory consumer protection laws applicable in the Customer's jurisdiction.
